General terms and conditions

1.     Scope of application

For the business relations between the GMP-Verlag Peither AG (in the following: vendor) and the orderer of our products only the following general terms and conditions, in the latest version at the time of the customer`s order, apply. Opponent, divergent or supplementary general terms and conditions of the customer shall not be part of the contract.

Our licence terms apply additionally in case of purchasing one of our online products as well as in the case of purchasing CD-ROM-, DVD and USB products.

2.     Registration and ordering

You have the opportunity to order via post or fax, via e-mail or telephone as well as from our website.

You initiate the ordering process via the website by clicking on the "Add to shopping cart" button. This will open the shopping cart window in which the contents of your shopping basket will be displayed. From there you can edit the shopping cart, go back to the shop or proceed to the checkout. During the ordering process, you can view and correct the contents of the shopping cart at any time using the "Shopping Cart" button on the right-hand side of the screen and the ”basket” button in the upper menu bar. To continue with the ordering process, click on the "Proceed to checkout" button. You will then be asked to register as a new customer with a personal account or to sign in with your user data or to continue shopping without registering as a guest. If you are not registered, you must enter your billing address and the desired delivery address in this step.

If you order for a company from other EU countries: Please make sure to enter the company VAT ID. Otherwise all invoices will be generated with sales tax. A correction of the invoice or refund of the sales tax is no longer possible afterwards.

If you click on the "Continue" button, you will receive an overview of all products that you have placed in the shopping basket, as well as all costs incurred in connection with your order. Here you can change the contents of the shopping cart again and make changes to the billing and delivery address as well as the payment method.

Before submitting your order by clicking the “Order now for a fee” button you have the opportunity to return to the shopping cart at any stage of the ordering process and correct your order. You can change the order quantity via the dropdown list under "Quantity". By clicking on the recycle bin symbol, the respective product will be removed from the shopping cart.

By clicking the “Order now for a fee” button, your order will be initiated and forwarded to us. With your order you declare bindingly that you want to purchase the goods.

3.       Customer account

If you have registered with a customer account, you will have an account dashboard available which enables you to view your most recent account activities, such as your orders. You can also manage or change your personal data, billing and shipping address, and the payment method you have chosen. The account dashboard also allows you to subscribe to our newsletter or download purchased downloads.

4.     Conclusion of contract

By placing your order you conclude a contract with the GMP-Verlag Peither AG.

The presentation of the products on our website does not represent a legally binding offer but is rather a non-binding online catalogue.

If you order through our website you will immediately be informed about the receipt of your order via the following e-mail “We have received your order”. This is an automatic order confirmation and at the same time an acceptance of the contract. After conclusion of the contract we will not store the wording of contract.

If ordered by post, fax, telephone or e-mail you will receive an order confirmation via post, fax or e-mail.

Available languages to conclude the contract are German and English.

5.     Cancellation of continuations

Continuations in the form of loose-leaf collections and CD-ROM or DVD can be cancelled any time - just send a notice in text form via fax, e-mail or letter.

For cancellation conditions of online licences please refer to the licence agreement which is made available during the order process.

6.     Reservation of non-availability

The fulfilment of your order takes place under the reservation of availability of the goods. If the ordered work is not published yet, the order will be pre-booked if possible. If works are out of print you have the choice, either to cancel your order or to put your name down for a possible reprint or a possible new edition. In any case, you will be informed about the unavailability of the article. We will immediately refund a possible paid purchase price.

7.     Packing and shipping costs

Our packing and shipping costs depend on the size and weight of the shipment as well as on the delivery address. If ordering through our website, the packing and shipping costs will be shown before the final placement of the order. The specific order shipping costs are shown again in the order confirmation.

8.     Prices and payment

The prices result from our current price lists, order forms and product descriptions. All prices are total prices including value added tax. On top of that, packing and shipping costs are added, in the currency mentioned on the invoice.

After receiving the invoice you can pay with your credit card or via credit transfer.

The purchase price is due for payment upon receipt of the invoice and payable without deduction within 14 days after issuing the invoice. If you decide to pay with credit card, your credit card will immediately be charged with the due purchasing price. The delivery of digital contents, provided for download only takes place when we have received the payment. If you want to receive digital contents provided for download as soon as possible, we recommend paying with credit card.

You will receive an invoice with every update for German language products, which are kept updated by follow-up deliveries.

We reserve to make deliveries on cash, partly prepayment or full prepayment. In this case we will inform you beforehand.

9.     Reservation of title

The delivered good remains in our property until the orderer performs full payment of purchase price. Without our prior, consent in text form you are not permitted to resell the good, which was delivered by us and is still under reservation of title.

10.    Warranty

The statutory warranty rights shall apply.

11.    Applicable law, court of jurisdiction and online settlement of disputes

The law of the Federal Republic of Germany shall apply, excluding the UN Convention on Contracts for the International Sale of Goods.

If the orderer is a merchant, a legal entity under public law or special fund under public law the exclusive jurisdiction for all disputes arising from this contractual relationship is the court having jurisdiction for our company’s headquarters (Schopfheim).

The European Commission provides an Internet platform for the settlement of disputes via the following link: http://ec.europa.eu/consumers/odr

This platform serves as a contact point of extrajudicial settlement of disputes regarding online purchase contracts or service contracts to which a costumer is party to.

 

Information pursuant to Section 36 VSBG (Alternative Dispute Resolution Act):

We are neither willing nor obliged to participate in dispute resolution before a consumer arbitration board.
